Descriptions of features reflect the service as made available from time to time and should not be understood as a promise that every referenced or planned capability is currently available.

3. Eligibility

You may use FPSTestR only if you are legally able to enter into these Terms under the laws applicable to you.

Younger users may access FPSTestR only where legally permitted and, where required, with appropriate involvement or permission from a parent or legal guardian. If you use FPSTestR on behalf of an organization, you confirm that you have authority to accept these Terms for that organization.

6. FPS Tester and Technical Results

FPSTestR’s browser-based tools are designed for informational, educational, visual-comparison, and browser-level testing purposes. Results may be affected by:

  • Browser behavior and scheduling
  • Device hardware
  • Operating-system behavior
  • Power and performance settings
  • Background applications and processes
  • Display refresh rate
  • Hardware acceleration
  • Rendering conditions
  • Other software or system factors
Results can vary.

Browser-based FPS results may vary depending on hardware, browser, display, and system conditions.

FPSTestR does not guarantee that browser-based test results are equivalent to results produced by professional laboratory, diagnostic, calibration, or hardware measurement equipment. Results should be interpreted in light of the conditions under which the test was run.

7. Accounts

If account functionality is made available, you may be required to provide accurate and reasonably current information. You are responsible for safeguarding your login credentials and for activity associated with your account to the extent permitted by applicable law.

You should promptly notify FPSTestR at support@fpstestr.com if you believe that your credentials have been compromised or that unauthorized account access has occurred.

8. Free Plan

FPSTestR offers or intends to offer access to the core homepage FPS Tester through a Free plan. Depending on current availability, free features may include:

  • Core FPS testing functionality.
  • Common FPS comparisons.
  • Educational information about FPS and displays.
  • Browser-based access without specialized software.

FPSTestR intends to maintain a useful free core experience, although specific features, limits, controls, and availability may change as the service evolves. This statement does not promise permanent access to every individual feature.

9. Pro Plan

FPSTestR may offer paid Pro functionality. Where available, Pro functionality may include custom FPS values, advanced comparison modes, deeper frame-time insights, saved test results, test history, export functionality, advanced visualizations, custom test duration, or additional testing controls.

Potential or planned features are not guaranteed unless they are specifically included in the offering you purchase. The current Pricing page or checkout interface should describe the features, limits, billing basis, and price applicable at the time of purchase.

10. Custom Services

FPSTestR may discuss tailored services for custom testing workflows, integrations, reporting, organizational use, custom feature requirements, or specialized projects.

Custom services may be subject to a separate written proposal, scope, statement of work, order form, or agreement. If those terms conflict with these Terms regarding the Custom service, the more specific written terms will apply to that service.

Pro and Custom inquiries

For questions about paid or Custom services, contact support@fpstestr.com.

11. Payments and Subscriptions

If FPSTestR introduces paid subscriptions or one-time purchases:

  • Pricing and the applicable billing frequency will be shown before purchase.
  • Payments may be processed through an independent third-party payment provider.
  • You will be responsible for providing valid payment and billing information to the applicable provider.
  • Taxes or similar charges may apply depending on the transaction, your circumstances, and your location.
  • Any recurring billing terms should be displayed before purchase.

The applicable purchase interface and any additional written terms will control the specific commercial details of a paid service.

12. Cancellations and Refunds

Cancellation, renewal, and refund terms for paid services will be presented on the relevant Pricing, checkout, subscription, or purchase page where applicable. Please review those terms before completing a purchase.

Nothing in these Terms limits any mandatory cancellation or refund rights that may apply under applicable law. For billing-related questions, contact support@fpstestr.com.

13. Intellectual Property

FPSTestR’s website design, original text, original graphics, branding, logos, software, interface elements, and other original content may be protected by applicable intellectual-property laws.

Subject to these Terms, FPSTestR grants you a limited, non-exclusive, non-transferable right to access and use the website for permitted purposes. This does not transfer ownership of FPSTestR content or technology to you.

Third-party names, trademarks, libraries, browser names, products, and technologies referenced on the website remain the property of their respective owners. Their inclusion does not imply ownership, endorsement, or affiliation unless expressly stated.

14. User Feedback and Communications

You may choose to send FPSTestR suggestions, bug reports, feature ideas, feedback, support messages, form submissions, or other communications.

FPSTestR may use non-confidential feedback about the service to improve its tools, features, and content, subject to applicable law and the Privacy Policy. This does not give FPSTestR unlimited ownership of every communication you send.

Please do not send confidential business information, trade secrets, regulated data, or other sensitive material unless appropriate arrangements have been made for that information.

15. Third-Party Services and Links

FPSTestR may link to or rely on independent third-party services, including services used for hosting, security, email delivery, payments, analytics, integrations, or external informational resources.

Third-party services operate under their own terms, privacy practices, and policies. FPSTestR does not control and is not responsible for the independent content, availability, security, or practices of third-party websites or services. You should review their applicable terms before using them.

16. Service Availability

FPSTestR aims to provide a useful and reliable website, but uninterrupted or error-free availability is not guaranteed. The service may occasionally be updated, modified, temporarily unavailable, or affected by maintenance, technical issues, security measures, internet conditions, or third-party dependencies.

FPSTestR may take reasonable steps to maintain, repair, secure, or improve the service, but these Terms do not create an uptime or service-level guarantee.

17. Disclaimers

To the extent permitted by applicable law, FPSTestR is provided on an “as available” basis. Information and results are supplied for general educational, technical, and visual-comparison purposes.

  • Browser-based results may vary between devices, displays, browsers, and test sessions.
  • FPSTestR is not a professional hardware certification or laboratory diagnostic service.
  • Use of the service does not guarantee improved gaming or system performance.
  • FPSTestR does not physically increase a device’s FPS or a monitor’s refresh rate.
  • Results are not a substitute for specialized diagnostic, calibration, or measurement equipment where such equipment is required.

Nothing in this section excludes warranties or rights that cannot lawfully be excluded.

18. Limitation of Liability

To the extent permitted by applicable law, FPSTestR will not be responsible for indirect, incidental, special, or consequential losses arising from use of, reliance on, or inability to use the service.

Such losses may include loss of data, loss of business opportunity, decisions made in reliance on test results, effects of device-configuration changes made by a user, or failures of third-party services.

Users remain responsible for evaluating results and for making appropriate backups before changing device, display, browser, driver, or system settings. Some jurisdictions do not allow certain limitations, so these limitations may not apply in every case.

19. Indemnification

Where permitted by applicable law, you may be responsible for reasonable claims, losses, or costs resulting from your unlawful use of FPSTestR, material violation of these Terms, violation of third-party rights, or misuse of the website.

This provision applies only to the extent fairly connected to your conduct and does not remove rights or protections that cannot lawfully be waived.

20. Suspension or Termination

FPSTestR may reasonably restrict or suspend access where necessary for security, abuse prevention, legal compliance, investigation of fraudulent activity, response to a serious violation of these Terms, or protection of the service and its users.

Where account functionality exists, you may stop using the service at any time and may request account-related assistance by emailing support@fpstestr.com. Any rights or obligations that by their nature should continue after access ends may remain effective.

21. Changes to the Service

FPSTestR may add or remove features, modify tools and interfaces, update pricing, or change plan structures as the service develops.

Where appropriate, material changes affecting an existing paid service should be communicated through the website, account interface, email, or another reasonable channel. Advance notice may not always be possible, including for urgent security, legal, or technical changes.

22. Changes to These Terms

FPSTestR may update these Terms from time to time to reflect changes to the service, business practices, or applicable requirements. When an update is published, the “Last Updated” date should be revised.

The current version is dated 15 Sep 2026. You are encouraged to review these Terms periodically. Continued use after updated Terms become effective may indicate acceptance where permitted by applicable law.

23. Governing Principles

These Terms are intended to operate in accordance with applicable law. Where specific consumer-protection rules or other mandatory legal rights apply based on a user’s location, those rights are not excluded by these Terms.

If FPSTestR later establishes a formal legal entity or governing-law jurisdiction, this section may be updated accordingly.

24. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions should continue to apply to the extent permitted by law. An affected provision should be interpreted or limited only as much as reasonably necessary.

25. No Waiver

A failure or delay in enforcing a provision of these Terms does not necessarily waive the right to enforce that provision or another provision later.

26. Entire Agreement

These Terms, together with applicable policies and any additional written terms governing paid or Custom services, form the agreement governing your use of FPSTestR.
